Trademark (trade mark)

Trademark (more commonly referred to as a «trademark») is a designation used to distinguish the goods and services of one person or entity from those of others.

The subject of trademark registration may be any designation or any combination of designations. Such designations may include, in particular, words, including personal names, letters, numbers, figurative elements, colors and combinations of colors, as well as any combination of such designations.

Legal protection cannot be granted to designations that:

- normally lack distinctiveness and have not acquired distinctiveness as a result of their use;

- consist solely of designations that are commonly used as names for goods and services of a particular type;

- consist solely of designations or information that are descriptive when used in relation to the goods and services specified in the application or in connection with them, including indications of the type, quality, composition, quantity, characteristics, purpose, value of the goods and services, or the place and time of manufacture, sale of goods, or provision of services;

- are false or misleading with regard to the goods, services, or the person manufacturing the goods or providing the services;

- consist solely of commonly used symbols and terms;

- represent only a form that is determined by the natural characteristics of the goods.

To register a Trademark (Trademark), an application must be filed.

The application must be prepared in Ukrainian and must contain:

- an application for trademark registration;

- an image of the trademark being applied for;

- a list of the goods and services for which trademark registration is sought, classified according to the Nice Classification.

The trademark registration application must specify the applicant or applicants and their address.

If the applicant seeks protection of a color or combination of colors as a distinctive feature of the trademark, the applicant must:

- state this in the application and specify the color or combination of colors for which protection is sought;

- provide a color representation of the trademark in the application.

Other requirements for application documents are established by the specially authorized state authority responsible for intellectual property matters.

A filing fee is payable upon submission of the application.

The application processing period is 6–8 months.
