In the systemof crimes against property includes such crimes: theft; robbery; burglary; theft of electric or thermal energy by its unauthorized use; extortion; fraud; embezzlement, embezzlement of property or its possession through abuse of official position; infliction of property damage by deception or breach of trust; unlawful appropriation by a person of another person's property that was found or happens to be in his possession; deliberate destruction or damage to property; intentional damage to electric power facilities; threat of destruction of property; destruction or damage to property due to negligence; breach of duty to protect property; unauthorized occupation of a land plot and unauthorized construction; acquisition, receipt, storage or sale of property obtained by criminal means.
In practice, lawyers most often encounter such a crime against property as fraud. Article 190 of the Criminal Code of Ukraine defines fraud as the seizure of another's property or acquisition of the right to property by deception or abuse of trust. Such a crime is punishable by a fine of up to fifty untaxed minimum incomes of citizens, or community service for up to two hundred and forty hours, or correctional labor for up to two years, or restriction of freedom for up to three years. The theory of criminal law distinguishes qualified attributes which are defined as all additional circumstances included in the corpus delicti of a crime and changing its qualification. On this basis, Article 190 of the Criminal Code distinguishes such qualified corpus delicti of fraud:
- fraud committed repeatedly, or by prior conspiracy of a group of persons, or causing significant damage to the victim. Such crime is punishable by a fine of fifty to one hundred untaxed minimum incomes of citizens, or correctional labor for a term of one to two years, or restriction of freedom for up to five years, or imprisonment for up to three years;
- fraud committed on a large scale or by means of illegal operations with the use of electronic computer equipment. The sanction for this crime is imprisonment for a term of three to eight years;
- fraud committed on a particularly large scale or by an organized group, which shall entail imprisonment for a term of five to twelve years with confiscation of property.
Fraud has certain features that allow us to distinguish this crime from other forms of theft: 1) the person who transfers the property (right to property) to the perpetrator, deluding himself, believes that the receipt - transfer of property is lawful, and he voluntarily transfers it to the guilty; 2) the person who transfers the property to the guilty, not aware of the fact of the crime; 3) with the transfer of property (right to property) the guilty also receive all the powers of the owner (or part of them).
