Foreigners and stateless persons in the territory of Ukraine have the same rights, guaranteed by the constitution of Ukraine, which the citizens of Ukraine have. Among them is the right to work. If a foreign citizen wants to fulfil the right to work on legal grounds, in that case the Ukrainian employer who wants to employ him, has to get the corresponding permission in territorial authorities of the ministry of social policy - permission for employment of nonresidents.

ORDER AND STAGES OF OBTAINING PERMISSION FOR EMPLOYMENT OF FOREIGN CITIZENS

1 stage of obtaining permission for employment

Submission of documents for obtaining the work permit in Ukraine

List:

For obtaining the permission for employment of foreigners or stateless persons, except for foreigners or stateless persons concerning whom is made a decision on drawing up the documents for the resolution of the issue of recognition of a person as a refugee, or a person needing additional protection, in that case the employer submits to the territorial authority next documents:

• statement
• copies of pages of the passport document of the foreigner or stateless person, with personal data along with the translation in Ukrainian certified in the order established by the legislation;
• registration number of taxpayer's registration card (Tax number of the foreigner);
• original of the work permit in Ukraine if the permit is extended;
• a receipt for payment of the work permit;
• one color photos of the foreigner or stateless person 3,5 x 4,5 centimeters.

The documents issued by bodies of other states have to be translated into Ukrainian, certified according to the legislation of the country of their delivery and legalized in accordance with the established procedure if other is not provided by international treaties of Ukraine,which obligation is agreed by the Verkhovna Rada of Ukraine.

Additional documents for obtaining the work permit in Ukraine

In addition, the employer gives on obtaining permission to employment of foreigners or stateless persons for:

1 foreigners sent by the foreign employer to Ukraine for performance of a certain amount of works (services) on the basis of agreements (contracts) signed between the native and foreign subject of managing, provided that the number of the qualified foreigners attracted within such agreements (contracts) does not exceed a half of total number of the persons working at the conditions of agreements (contracts) - the copy of the agreement (contract) signed between native and foreign subjects of managing, which provides application of work of the foreigners and stateless persons sent by the foreign employer to Ukraine for performance of a certain amount of works (services);

2 foreigners, who relate to the category "intra corporate assignees", according to the schedule of specific obligations in sector of services of the Protocol on Ukraine's accession to the WTO (article II of the General agreement on trade in services) - the decision of foreign subject of managing about the transfer of the foreigner or the stateless person for work to Ukraine and copy of the contract signed between the foreigner or stateless person and the foreign subject of managing about the transfer to work in Ukraine with determination of term of work in Ukraine;

3 concerning the persons applying for holding the post of the head, deputy head or other senior position, provided that such foreigner or the stateless person is the founder or the cofounder of the enterprise, establishment, organization - copies of the constituent documents certified in accordance with the established procedure;

4 concerning persons, who are the subject of copyright and allied rights and are invited to work in Ukraine for implementation of such rights - copies of documents certified notarial, identifying the object of copyright and (or) allied rights of the author and testify authorship (copyright).

In case if such documents are issued outside Ukraine, they have to be legalized in accordance with the established procedure, if international treaties of Ukraine do not provide other, which obligation is agreed by the Verkhovna Rada of Ukraine, and are presented along with the translation in Ukrainian, certified in accordance with the established procedure.

The list of the documents necessary for obtaining permission for refugees or the persons needing additional protection

For obtaining the permission for employment of foreigners or stateless persons, concerning whom is made a decision on drawing up the documents for the resolution of the issue of recognition of a person as a refugee, or a person needing additional protection, in that case the employer submits next documents:

• statement;
• copies of the decision of drawing up the documents for the resolution of the issue of recognition of a person as a refugee, or a person needing additional protection and certificates of the request for protection in Ukraine;
• two color photos of the foreigner or stateless person 3,5 x 4,5 centimeters.

For extension of action of the permission for employment of foreigners or stateless persons, the employer, not later than 30 calendar days before the end of action of permission, submits to the territorial authority next documents:

• statement;
• two color photos of the foreigner or stateless person 3,5 x 4,5 centimeters;
• the reference from the Ministry of Internal Affairs, that the foreigner or the stateless person, who at the time of registration of permission is in the territory of Ukraine, does not serve sentence for commission of crime and concerning him are not carried out the criminal proceedings.

Other documents provided by the above lists are submitted in case of introduction of changes in them.

The territorial authority accepts the documents according to the inventory and issues a copy to the employer.

3 stage of obtaining permission for employment

Introduction of payment and period of validity of permission for employment of foreigners

The territorial authority within 7 calendar days (extension of the work permit - 3 calendar days) considers the submitted documents and makes a decision, which is made out by an order of the territorial authority, and then not later than within three working days from the date of its acceptance, the decision goes to the employer and is published on the website of the territorial authority. 

In case of the adoption of a positive decision, the employer within 10 calendar days from the date of decision-making transfers funds. In case if the employer does not deposit the payment within 10 calendar days from the date of making decision about the issue of permission, then such decision is cancelled.

The work permit in Ukraine is issued for the period specified in the contract. The validity of such permission may be extended for the same period.
