Diia City – On July 15 government of Ukraine supported in the second reading a bill that created Diia City in Ukraine - a special legal and tax regime for the IT industry. The project was developed by the Ministry of Digital Transformation. A resident of Diia City is a tax payer who pays corporate income tax on special conditions: 50% less tax paid. Resident of Diia City who, in accordance with the procedure provided for in paragraph 141.10 of Article 141 of the Tax Code, has chosen or switched to the appropriate taxation regime. Residents of Diia City who have not chosen (have not switched) to the appropriate taxation regime pay corporate income tax on a general basis and are considered residents of Diia City, which are not tax payers on special conditions – clause 14.1282 clause 14.1 of Article 14. IT companies can join the Diia City, becoming its residents. The conditions of the regime are fixed for 25 years. Residency is voluntary; residents are covered by the system of state guarantees of investment protection. The law provides for the possibility of changes in taxation over 25 years, but only business-friendly changes. Gig contracts instead of Individual Entrepreneur, "non-competition" in contracts In Diia City, there are features – innovations for our legislation, namely gig contracts instead of Individual Entrepreneur and clauses on "non-competition" in contracts. A gig contract is an alternative to Individual Entrepreneur – it is an agreement under which a specialist undertakes to perform work on the instructions of a resident company, and the customer undertakes to pay for the work performed and provide the employee with social guarantees and proper working conditions. Gig contracts will be tied to the company, unlike Individual Entrepreneur. Gig specialists will be able to terminate the contract with the company by notifying the second party 30 days in advance. In case of immediate termination of the contract by the company, the specialist will receive compensation in the amount of a monthly salary. Social guarantees are also provided: at least 17 days of vacation per year, sick leave at the expense of the company and the Social Insurance Fund, a maternity break for women. The resident companies of the Diia City will also be able to sign non-competition agreements with specialists (at the request of the parties). These contracts will oblige the specialist not to work in the same direction and not to use the same technology in another company for a year after dismissal.
