Citizenship of Ukraine – it is a close legal connection between physical person and Ukraine, which is reflected in their mutual rights and obligations. Foreigners / stateless persons can be adopted to the citizenship of Ukraine, if they filed a petition and meet all the conditions which are provided for the adoption of the citizenship of Ukraine and provided all the necessary documents.
There are some conditions for the adoption of the citizenship of Ukraine:
1 recognition and compliance of the Constitution of Ukraine and laws of Ukraine
2 submission of declaration of the absence of foreign citizenship (for stateless persons) or obligation to terminate foreign citizenship (for foreigners).
If foreigner is a citizen of several states, he must submit an obligation to terminate the citizenship of these states. Foreigner who has a refugee status in Ukraine or asylum in Ukraine, submit a declaration of renunciation of foreign citizenship, the document is submitted instead of an obligation to terminate foreign citizenship. There is no need to provide obligation to terminate foreign citizenship from foreigners who are citizens of states whose legislation establishes termination of citizenship automatically after the acquisition of citizenship of another state, or whether such rule is established in international treaties of Ukraine with other States. Foreigners who have filed an obligation to terminate foreign citizenship shall submit a document on termination of citizenship to the appropriate authority for 2 years from the date of adoption of the citizenship of Ukraine. If they are unable to obtain such document for reasons beyond their control they, must submit a declaration of renunciation of foreign citizenship.
3 Continuous legal residence on the territory of Ukraine for the past 5 years
In this condition, there are some exceptions.
This condition does not apply to those categories of foreigners / stateless persons:
- Who are married to a citizen of Ukraine for more than 2 years;
- Who have been married to a citizen of Ukraine for more than 2 years and the marriage ceased due to the death of a citizen of Ukraine.
Two-year stay in a marriage with a citizen of Ukraine shall not apply to foreigners and stateless persons who have been granted permission to immigration as one of the spouses if the other spouse, with whom he/she was married for more than two years old is a citizen of Ukraine. , Legally established period of continuous residence for persons who have been granted refugee status in Ukraine or asylum in Ukraine is 3 years from the date of the granting of refugee status in Ukraine or asylum in Ukraine, and for persons who entered Ukraine as stateless persons - 3 years from the entry into Ukraine.
4 permission to immigrate
This condition does not apply to persons who have been granted refugee status in Ukraine or asylum in Ukraine and foreigners and stateless persons who arrived in Ukraine for permanent residence prior to the entry into force of the Law of Ukraine "On Immigration" (Aug 7, 2001) and have residence mark in the passport of a citizen of the former USSR of the 1974 standard or obtained a permanent residence permit in Ukraine.
5 speaking state language or its understanding at a level sufficient to communicate
This condition does not apply to persons who have certain physical disabilities (blind, deaf, mute)
6 availability of lawful sources of income
This condition does not apply to persons who have been granted refugee status in Ukraine or asylum in Ukraine.
Individuals who have rendered outstanding service to the Ukraine, or whose adoption to the citizenship of Ukraine is a state interest for Ukraine are not obliged to fulfill such conditions as: Continuous legal residence on the territory of Ukraine for the past 5 years; permission to immigrate; speaking state language or its understanding at a level sufficient to communicate; availability of lawful sources of income.

Acceptance of a child into the citizenship of Ukraine, who lives in Ukraine and one of whose parents or any other person who is his legal representative and has a permit for immigration to Ukraine, is carried out without regard to these conditions:

2 continuous legal residence on the territory of Ukraine for the past 5 years;

Also, permission to immigrate to Ukraine is not required if the legal representative of the child is a person who has been granted refugee status in Ukraine or asylum in Ukraine, or a foreigner or a stateless person, who arrived in Ukraine for permanent residence prior to the entry into force of the Law of Ukraine "On Immigration "(Aug 7, 2001) and have mark about a residence permit in the passport of a citizen of the former USSR or received a residence permit in Ukraine. Persons who have acquired citizenship of Ukraine and submitted a declaration of renunciation of foreign citizenship, undertake to return the passport of a foreign country to the competent authorities of that State. This requirement does not apply to persons who have been granted refugee status in Ukraine or asylum in Ukraine. The date of acquisition of the citizenship of Ukraine is the date of publication of the corresponding Decree of the President of Ukraine.
CAUTIONS AND NOTES (IMPORTANT)
Persons can not be adopted into Ukrainian citizenship if:
1 committed a crime against humanity or committed genocide;
2 convicted in Ukraine to imprisonment for committing crimes punishable by 5 and more years of imprisonment, taking into account the level of threat to national security;
3 committed on the territory of another state actions recognized by the legislation of Ukraine as crimes punishable by 5 and more years of imprisonment.
